Concerns: (1) Whether a court of appeals might count on extra-record accurate research study to choose a petition for evaluation of an elimination order regardless of a statutory command that such a petition be chosen “just on the administrative record,” 8 U.S.C. § 1252( b)( 4 )( A); and (2) whether federal court authority to choose constitutional claims and concerns of law under 8 U.S.C. § 1252( a)( 2 )( D) allows evaluation of legal mistake in exemption decisions under 8 U.S.C. § 1182( d)( 3 )( B)( i).
